Terms and Conditions

Last Updated: July 2026

Welcome to Apex Web Creation (“we”, “our”, “us”). By accessing our website (the “Site”) or purchasing our web design, development, restoration, or editing services (the “Services”), you agree to be bound by these Terms and Conditions (“Terms”).

Please read them carefully. If you do not agree to these Terms, you must not use our Site or Services.

1. Company Information & Contact

Apex Web Creation operates as a professional web design agency based in the United Kingdom.

  • Email: contact@apexwebcreation.com

2. Proposals, Quotes, and Deposits

  • Validity of Quotes: Any written quote or proposal we provide is valid for 30 days from the date of issue.
  • Booking Deposit: To secure your project slot and begin work, a non-refundable deposit of 50% of the total project fee is required (unless otherwise agreed in writing).
  • Work Commencement: We will not schedule your project or begin any design work until the deposit has cleared in our bank account.

3. Client Responsibilities & Content Delivery

To keep your project on schedule, we rely heavily on your cooperation.

  • Content Provision: You agree to provide all text, images, logos, and login credentials (hosting, domain registrars, etc.) required for the build in a timely manner.
  • Project Delays: If a project is delayed by more than 30 days because you have not provided the necessary content or feedback, we reserve the right to pause the project, invoice you for work completed up to that date, and apply a restart fee to resume the project.

4. Revisions & Approval Process

  • Review Phase: We work collaboratively. You will be provided with a private preview link to review the design. Our standard project fee includes up to two (2) rounds of minor revisions during the design phase.
  • Scope Creep: Any structural changes, additional pages, or feature requests made after you have approved the initial design outline will be treated as “out of scope” and invoiced separately at our standard hourly rate.
  • Final Approval: Once the build is complete, you will be asked to sign off on the site in writing (via email) before we push it live.

5. Payments, Fees, and Launch

  • Final Balance: The remaining 50% of the project fee is due immediately upon your final approval of the website and before the website is migrated to your live server or domain.
  • Launch Policy: Under no circumstances will we launch a website, hand over administrator credentials, or transfer files to your live hosting environment until the final balance has been paid in full and cleared.

6. Intellectual Property & Ownership

  • Our Intellectual Property: We retain ownership of all design concepts, code, and mockups created during the build until your final payment is cleared.
  • Transfer of Ownership: Upon receipt of final payment, full intellectual property rights and ownership of the completed custom website design are transferred to you.
  • Third-Party Licenses: You are solely responsible for obtaining and maintaining licenses for any premium third-party plugins, themes, fonts, or stock imagery used on your site.

7. Limitation of Liability & Warranties

  • No Ongoing Warranty: While we build your site using clean, optimised, and secure code, we do not guarantee that the website will run uninterrupted or entirely error-free indefinitely, as web browsers, WordPress core files, and third-party plugins update constantly.
  • Security & Hacking: We implement industry-standard security baselines. However, we are not liable for any security breaches, malware infections, or hacking incidents that occur after the website has been successfully handed over to you.
  • Financial Liability: To the maximum extent permitted by UK law, Apex Web Creation will not be liable for any indirect, incidental, or consequential damages (including loss of business, revenue, profits, or data) arising out of the use of or inability to use our Services. Our total liability to you will not exceed the total amount paid by you for the Services.

8. Third-Party Hosting and Platforms

  • Hosting Responsibility: We are a web design and development agency, not a hosting provider. You must purchase hosting and a domain name from a reputable provider. We are not responsible for hosting server downtime, slow loading speeds caused by poor host servers, or hosting email configuration issues.

9. Termination of Agreement

  • By the Client: You may terminate the project at any time by giving us written notice. In the event of termination, your 50% deposit is non-refundable, and you will be invoiced for any additional hours worked on the project beyond the deposit value.
  • By Us: We reserve the right to terminate our agreement if you breach these Terms, use abusive language, or fail to communicate with us for more than 45 days.

10. Governing Law

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales (or Scotland / Northern Ireland, if applicable). You agree that the courts of the United Kingdom shall have exclusive jurisdiction to settle any disputes.
